1. Acceptance of Terms

By accessing or using Crash BASIC Arcade ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Crash BASIC Arcade is a platform for sharing and playing games created with the Crash BASIC programming language. Users can upload games, browse games uploaded by others, and interact with the community through ratings and reviews.

3. User Accounts

You must provide accurate information when creating an account
You are responsible for maintaining the security of your account credentials
You must be at least 13 years old to create an account or use the Service. Crash BASIC Arcade does not permit users under the age of 13. If you are under 13, you may not create an account or use the Service in any way
One person may not maintain multiple accounts
You are responsible for all activity that occurs under your account

4. User-Generated Content

4.1 Your Content

You retain ownership of the games and content you upload. By uploading content, you grant Crash BASIC Arcade a non-exclusive, worldwide, royalty-free license to:

Host, store, and display your content on the Service
Create thumbnails and previews of your content
Allow other users to play your games through the Service

This license ends when you delete your content from the Service.

4.2 Content Responsibility

You are solely responsible for the content you upload. You represent and warrant that:

You own or have the necessary rights to the content you upload
Your content does not infringe on any third party's intellectual property rights
Your content complies with these Terms and all applicable laws

5. Acceptable Use Policy

5.1 Content Rating Requirement

All content on Crash BASIC Arcade is rated using the ESRB-style system (E, E10+, T, M). Content rated E (Everyone) is publicly accessible. Higher ratings require a subscription. Adults Only (AO) content is strictly prohibited and will not be hosted on this platform under any circumstances.

5.2 Prohibited Content

Crash BASIC Arcade is a platform for all ages 13 and up. Adults-only content is never permitted. You agree NOT to upload, post, or transmit content that:

Is adult or sexually explicit - Pornography, nudity, sexual content, or any material intended for adult audiences only. This includes suggestive imagery, sexual themes, and any content that would receive an AO (Adults Only) rating. Adults-only content is strictly prohibited and will result in immediate removal and potential account termination
Contains excessive violence or gore - Graphic depictions of violence, blood, dismemberment, or torture beyond what is acceptable in M-rated (Mature 17+) content
Depicts illegal drug use - Glorification or detailed depiction of illegal drug use or drug manufacturing
Infringes intellectual property - Copyrighted material, trademarks, or other proprietary content you don't have rights to use
Contains malware - Viruses, trojans, or any malicious code
Is illegal - Content that violates any applicable law or regulation
Promotes hate or violence - Content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, or disability
Harasses others - Bullying, threats, or targeted harassment
Is deceptive - Phishing, scams, or misleading content
Impersonates others - Pretending to be another person or organization
Contains gambling with real money - Real-money gambling or casino simulations that could be used for actual wagering

5.3 Content Guidelines

Crash BASIC Arcade is designed for users ages 13 and up. When in doubt, ask yourself: "Would this be appropriate for a teenager to play?" If the answer is no, it doesn't belong on Crash BASIC Arcade. The maximum allowable content rating is M (Mature 17+). Examples of acceptable content include:

Cartoon or fantasy violence (similar to classic arcade games)
Mild language (no strong profanity)
Themes appropriate for teen audiences

6. Content Moderation

We reserve the right to:

Review content before or after publication
Remove content that violates these Terms
Suspend or terminate accounts that violate these Terms
Report illegal content to appropriate authorities

Content removal decisions are at our sole discretion. We are not obligated to restore removed content.

7. Copyright and DMCA

7.1 Reporting Copyright Infringement

If you believe content on Crash BASIC Arcade infringes your copyright, please send a DMCA takedown notice to:

7.2 Counter-Notification

If your content was removed and you believe it was removed in error, you may submit a counter-notification with:

Identification of the removed material and its former location
A statement under penalty of perjury that removal was a mistake or misidentification
Your name, address, and phone number
Consent to jurisdiction of federal court in your district
Your physical or electronic signature

7.3 Repeat Infringers

We will terminate accounts of users who are repeat copyright infringers.

8. Premium Subscriptions

Premium subscriptions are billed monthly at the rate displayed at checkout
Subscriptions automatically renew unless cancelled
You may cancel at any time; access continues until the end of the billing period
Refunds are provided at our discretion for technical issues or billing errors
We reserve the right to change subscription pricing with 30 days notice

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

The Service will be uninterrupted or error-free
Defects will be corrected
The Service is free of viruses or harmful components
User-generated content is accurate, reliable, or appropriate

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRASH BASIC ARCADE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or goodwill
Content uploaded by users
Any unauthorized access to your account
Any interruption or cessation of the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Crash BASIC Arcade, its operators, and affiliates from any claims, damages, or expenses (including attorney fees) arising from:

Your use of the Service
Content you upload or submit
Your violation of these Terms
Your violation of any third party's rights

12. Account Termination

We may suspend or terminate your account at any time for:

Violation of these Terms
Suspected fraudulent or illegal activity
Extended periods of inactivity
At our sole discretion with or without cause

Upon termination, your right to use the Service ceases immediately. We may delete your content after termination.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Tennessee.
